Swing State upgrades race once again
They have now declared this a "Safe Dem" seat. This is the only seat they rank as flipping that they are declaring safe.

Rep. Vito Fossella arrested May 01, 2008 for DWI. Fossella had a .17 BAC. On October 17 he was convicted. On December 8 his conviction stood and he was sentenced to serve five days in jail. After his sentencing he appealed the verdict and now is awaiting a retrial.
Retrial date: early 2009
