Rep. Vito Fossella arrested May 01, 2008 for DWI. Fossella had a .17 BAC. On October 17 he was convicted. On December 8 his conviction stood and he was sentenced to serve five days in jail. After his sentencing he appealed the verdict and now is awaiting a retrial.
Retrial date: early 2009

On the SI Advance Political Forum someone stated that Vito agreed to begin talks on this after Labor Day but I don't think it's true since they would have publicized it.
Great! I hope he does agree. How ever I agree that it is probably more posturing than anything.
