Vito unaware of how Congress functions

Yesterday the Politicker ran a quote from Rep. Vito Fossella about the Foley scandal;

There are currently federal and state investigations that are going on as well as an investigation by the House Ethics Committee.

Unfortunately the last part was not true. Congress was in recess since Saturday. The House Ethics Committee had not meet yet. Candidates are home campaigning and were not investigating this. Don't take my word for it, here is what CNN said about the first meeting of the House Ethics Committee TODAY;

The House Ethics Committee convened Thursday and approved 48 subpoenas, which could be served to House members, officers and staff members.

There was no investigation prior to them meeting and agreeing to investigate this today. I know it is the difference of at minimum a day depending on when this talking point was drafted, but how do you not know whether or not Congress is investigating this?
